These Terms of Service (the "Terms") are a binding agreement between you and Upgig LLC ("UpGig", "we", "us"), and govern your access to and use of the UpGig platform and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using UpGig you confirm that you meet this requirement, that the information you provide is accurate, and that you have the right to share any content you upload.
You are responsible for keeping your login credentials secure and for all activity that happens under your account. You must provide accurate information when creating your account, and notify us promptly at support@upgig.ai if you believe your account has been accessed without your permission.
For job seekers, UpGig Jobs helps you discover jobs, build and tailor application materials, and apply to roles, including optional auto-apply. For employers, UpGig is an AI-powered hiring platform to post jobs, track applicants, screen and score resumes, schedule interviews, and run branded careers pages.
Job listings shown to job seekers come from third-party sources and public job boards and may be inaccurate, out of date, or already filled. UpGig is a tool: we are not an employer, recruiter, or staffing agency, and we do not guarantee responses, interviews, or job offers.
You retain ownership of the content you provide, such as your resume, profile details, job postings, and preferences. You grant UpGig a non-exclusive license to store, process, transmit, and display that content as needed to operate and provide the Service to you, including sending a job seeker’s application materials to employers when they apply.
If you are an employer and you upload candidate data (including resumes and bulk imports), you confirm you have a lawful basis to provide that data to us for screening and hiring purposes and that you will handle it in accordance with applicable law.
Some features use automated and AI-based processing, including resume parsing, job matching, generated cover letters, resume tailoring, interview preparation, optional auto-apply, and employer-side resume scoring. AI output can be inaccurate, incomplete, or biased. You are responsible for reviewing anything generated on your behalf before relying on it or sending it. AI scores are decision-support only; employers remain solely responsible for their hiring decisions and for complying with applicable employment and anti-discrimination laws.
If you enable auto-apply, you authorize UpGig to submit applications on your behalf to roles that match the preferences and limits you set. Those applications may include your resume, generated cover letters, and contact details, and may be delivered to employers or their representatives by email or through third-party application systems.
You control auto-apply from your settings, including turning it on or off and setting how many applications may be sent within your plan limits. You remain responsible for applications submitted under your account.
UpGig offers optional paid subscriptions. The price, billing period, and renewal terms are shown to you before you confirm a purchase. Subscriptions renew automatically for the same period until you cancel, and applicable taxes may be added.
On the web, subscriptions are processed by our payment provider, and you can manage or cancel from the billing portal in the app. On Android, subscriptions are processed through Google Play, and you must manage or cancel them in your Google Play account. Purchases made through Google Play are also subject to Google Play terms.
Except where required by law or by the applicable app store policy, payments are non-refundable. Cancelling stops future renewals; you keep paid access until the end of the current billing period.
You agree to use the Service only for lawful purposes. You agree not to upload unlawful, false, or infringing content, not to impersonate any person or company, not to harass or discriminate against candidates, not to harvest data about other users, not to send spam, and not to misuse, disrupt, reverse engineer, or attempt to gain unauthorized access to any part of the Service. We reserve the right to terminate accounts that violate these terms.
The Service links to and interacts with third parties, including employers, job boards, and application systems. We are not responsible for the content, policies, hiring decisions, or conduct of any employer or third party, and your dealings with them are solely between you and them.
UpGig™ is a trademark of Twin Designs & Tech. UpGig, the UpGig logo, and all related names, designs, and original content are the exclusive property of their owners and are protected by trademark, copyright, and other intellectual property laws. You may not use the UpGig name or marks without prior written permission. You retain ownership of the content you upload to the platform.
You may stop using the Service and permanently delete your account at any time from Settings (see our account deletion page). We may suspend or end your access if you violate these Terms or use the Service in a way that could cause harm or legal exposure.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. UpGig does not warrant that the Service will be uninterrupted or error-free, or that job listings or AI output will be accurate.
To the maximum extent permitted by law, UpGig will not be liable for indirect, incidental, special, or consequential damages, or for lost opportunities, arising from your use of the Service. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect means you accept the updated Terms.
